1. Acceptance of Terms
Welcome to CryoVita+ LLC (“CryoVita+”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your use of our at-home CryoSlimming and targeted Cryotherapy services (the “Services”).
By booking an appointment or using our Services, you agree to be bound by these Terms, our Privacy Policy, and our Informed Consent and Liability Waiver. If you do not agree to these terms, please do not use our Services.
2. Description of Services
CryoVita+ LLC provides premium, non-medical, cosmetic cryotherapy services delivered to your location. Our services are for aesthetic purposes only and are not intended to diagnose, treat, cure, or prevent any medical condition. Our certified specialist will perform the services in a professional manner, but we make no guarantees about specific results, as individual outcomes vary.
3. Client Eligibility and Responsibilities
To use our Services, you must:
- Be at least 18 years of age.
- Provide accurate, complete, and current personal and health information as requested.
- Disclose all medical conditions, allergies, and contraindications prior to treatment.
- Follow all pre- and post-treatment care instructions provided by our specialist.
You understand that withholding medical information or failing to follow instructions can increase the risk of complications and may result in the termination of services without a refund.
4. Appointments, Cancellations, and Rescheduling
- Booking: Appointments are booked on a first-come, first-served basis. A valid payment method is required to secure your appointment.
- Cancellations: We require a minimum of 24 hours’ notice for any cancellation. Cancellations made with less than 24 hours’ notice will be charged a cancellation fee equivalent to 50% of the scheduled service price.
- No-Shows: If you are not available at the scheduled time and location for your appointment, it will be considered a “no-show,” and you will be charged the full price of the scheduled service.
- Rescheduling: You may reschedule your appointment without penalty if you provide at least 24 hours’ notice.
5. Payment, Billing, and No Refund Policy
- Payment: Full payment is due at the time of service. We accept major credit/debit cards and other approved payment methods.
- No Refund Policy: All sales are final. Services rendered, packages, and gift certificates are strictly non-refundable. By booking our Services, you acknowledge and agree that you are paying for the time, expertise, product, and equipment of CryoVita+ LLC, not for a guaranteed outcome.
6. Informed Consent and Assumption of Risk
All clients are required to read, understand, and sign our Informed Consent and Liability Waiver form before their first treatment session. This document provides detailed information about the potential risks, benefits, and alternatives to the procedures. By signing this form and proceeding with treatment, you voluntarily accept and assume all risks associated with the Services.
7. Limitation of Liability
To the fullest extent permitted by law, CryoVita+ LLC, its owner, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any other intangible losses, resulting from (a) your access to or use of or inability to access or use the services; (b) any adverse effects, injury, or complications arising from the services, except in cases of our gross negligence or willful misconduct; (c) your reliance on any information or results obtained from the services.
8. Privacy
Your privacy is important to us. Our collection and use of your personal and health information are governed by our Privacy Policy, which is incorporated into these Terms by reference.
9. Governing Law and Dispute Resolution
These Terms and any dispute arising out of or related to them or the Services shall be governed by the laws of the State of Texas, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Kaufman County, Texas.
10. Termination of Service
We reserve the right to refuse or terminate service to anyone for any reason at any time, including but not limited to, non-compliance with these Terms, providing false information, or engaging in inappropriate or unsafe behavior. If we terminate your service due to your breach of these terms, you will not be entitled to a refund.
11. Changes to Terms of Service
We may revise these Terms from time to time. The most current version will always be available upon request or on our website. By continuing to access or use the Services after revisions become effective, you agree to be bound by the revised Terms.
